PROJECTA won the first instance of a patent litigation on Digital decorating machines
The Court of Bologna has closed, by the legal judgement n. 258/2021, the first instance of three joined judicial cases, deeming that the Competitors Sacmi Cooperativa Meccanici Imola soc. Coop and current Sacmi Tech S.p.a. are guilty of infringement of some patents belonging to Projecta Engineering Srl (Italian patent n. 1409620, the Italian portion of the European patent no. 2492098 and Italian patent no. 1409622) with reference to the machines “Colora HD Black” and “DHD” (the last ones only if equipped with telescopic guide systems and /or suction elements placed among the printing bars at a suction level higher than bar printing level) and in any case to all machines falling within the scope of the patents activated by Projecta Engineering in the case.
The case is presently waiting for the second instance in front of the Court of Appeal of Bologna but all the Court orders in the first instance of the legal judgement remains executive since the Court of appeal has rejected the request for suspension of the same.
